Abstract

This study is part of a presentation and critique of the Constitutional Court's case law on regional legislative power. After general background considerations on regional autonomy, the study presents the changes introduced to the framework of regional legislative power by the 6th constitutional revision. It is in this context that Judgement 258/2007 (Azores - Protocolary Precedence and Regional Mourning) is presented and commented upon, in which the Constitutional Court established its orientation regarding the interpretation of the requirement that the legislation of the Autonomous Regions must concern the “regional scope”.
