Abstract

The present text aims to reflect the presentation of the author during the Workshop Pandemic and Disinformation: Iberian Legal Perspectives, which took place on October 7, 2021. The presentation focused on the state of exception and the fight against fake news in a pandemic context, through an analysis of the Portuguese case, by looking at specific examples of abusive exercise of rights in the digital space, namely two in particular: (i) the example of the presidential decree that declared the first state of emergency in March 2020 and (ii) the “alleged” second Lockdown Easing Plan, released in March 2021.
