The regime of the consequent acts of annulled acts. Defense of a restricted concept of consequent act

This article deals with the regime of the consequent acts of annulled acts, which is provided, in parallel, in article 172 of the Administrative Procedure Code and in article 173 of the Administrative Court Procedure Code. The application of this regime raises multiple uncertainties, namely regarding the scope of the concept of ‘consequent acts’, the term of intervention on these acts and the scope of the protection of bona fide beneficiaries of consequent acts’ and ‘third parties with a legitimate interest in maintaining incompatible situations’. By defending a restricted concept of a consequent act, the intention is to critically analyse the regime of the consequent acts of annulled acts, without disregarding the doctrine and jurisprudence issued on this matter.
