Abstract

There are multiple determinants of international migration, but family reasons stand out, especially through family reunification, which is one of the main channels for regular entry into Europe. While European countries cannot formally deny the right to family reunion, they do control entry and residence of immigrants, thereby restricting it. This article provides a sociological and historical analysis of the legal framework for family reunification in Portugal up to 2025 (structure effect), which has made Portugal the most favourable European country for this right. Based on complaints received by the ombudsman, between 2004 and 2024, the article examines the administrative practice of the right to family reunification, considering the experiences of immigrant families and institutions involved in the process. It highlights individuals’ ability to interpret, adapt to, and react to the right to family reunification (agency effect).

Investigadora no Centro de Administração e Políticas Públicas (CAPP) e professora de Sociologia das Migrações e de Análise de Dados do Instituto Superior de Ciências Sociais e Políticas (ISCSP-ULisboa). Doutorada em Sociologia, assumiu a direção do Observatório das Migrações, entre 2005 e 2024, e foi adjunta de três altos-comissários para as Migrações, entre 2005 e 2015.
