Abstract

In May 2024, the European Union approved the new pact on migration and asylum to address structural deficiencies in the Common European Asylum System. This article takes a qualitative political-legal approach to analyze the pact’s strategies and assess its compatibility with human rights. The research results indicate that the European Commission prioritizes regulations that standardize migration policies and reduce inequalities between Member States. However, evidence suggests that the pact’s supranational dimension is compromised by the politicized nature of Member States’ use of technocratic language to conceal potential human rights violations. Despite written legal compliance, the implementation of the pact raises concerns about effectively safeguarding the rights of asylum seekers at European borders.
