First Notes on Digital Services Coordination in the Digital Services Act; In Particular, the Portuguese Case

Abstract

The Digital Services Act (DSA) has as one of its main objectives the protection of the fundamental rights of users of digital platforms, enforcing various requirements on these platforms. As a guarantee that all the online platforms make good on their obligations, the DSA creates a multi-level pyramidal structure consisting of the Digital Services Coordinators, European Board for Digital Services and Commission, in ascending order. It is at the base of this structure that we verify greater proximity to the Member-States, with the latter being responsible for designating their Digital Services Coordinator and specifying their competences. In Portugal, ANACOM was designated as the Digital Services Coordinator, with ERC and IGAC as competent authorities, albeit in a manifestly insufficient manner. In this study, we will analyze ANACOM's current position and the challenges it will face in its activity, considering the Portuguese context, carrying out a prospective exercise on the future of the Portuguese Digital Services Coordinator.
