Chevron and Mead - An analytical approach
Keywords:
Judicial Deference; Discretion; Competence; Analytic Legal TheoryAbstract
This text addresses the issue of judicial deference, in the famous Chevron case, in dialogue with the subsequent ruling in the Mead case, both ultimately decided by the United States Supreme Court of Justice. The presentation of the cases and the classical ideas associated with it is combined with an analysis and critique from an analytical standpoint, in order to pin out the elements and reasoning that are questionable in the foresaid decisions, while, at the same time, looking to present alternative views and reasoning, to address these flaws and strengthen the intended scientificity of these judicial decisions.
