Incompatibilities pursuant to holding political and public and political office and the prevention of corruption

Abstract

The purpose of this article is to contribute to a reflection about the role of the incompatibilities and impediments regime, established by the Portuguese Law n.º 52/2019, of July 31st. We will make an introductory and structuring analysis that intends to justify the regime and then we will look into it, scrutinizing the fulfillment of the principles and values presented. We will reflect on the effectiveness and suitability of the adopted solutions, bearing in mind the objective of preventing corruption. In this sense, we will detect the greatest weaknesses and highlight those that worry and amaze.
