The increase of transparency as a way to prevent corruption in public procurement: measures recently approved in connection with the 2020-2024 Anticorruption National Strategy

Abstract

The 2020-2024 Anticorruption National Strategy (Estratégia Nacional Anticorrupção) was approved as a way to prevent corruption practices in the different public instances. In this context, this important document lists a set of mechanisms aimed at promoting greater transparency in public procurement. This article addresses the main changes occurred in public procurement law in order to achieve greater transparency in this field. These changes were enacted by means of Law no. 30/2021, of 21 May (which amends the Portuguese Public Procurement Code) and DecreeLaw no. 109-E/2021, of 9 December (which implements the Anticorruption National Strategy and provisions important contributions to public procurement applicable legislation).
