Some Proposals for the amendment of the Legal Framework of the Energy Efficiency of Buildings

Abstract

Energy efficiency policies have been part of the European Union legal framework for thirty years. Due to its high consumption profile, buildings have been one of the focus of these policies. In Portugal, these policies have been developed due to the European influence. At this time, it is in force the DecreeLaw no. 118/2013, of 20th of August, which has already been amended, with the last being made by the Decree-Law no. 95/2019, of 18th of July. Approaching the need to amend again this legislation due to the “Clean Energy for all the Europeans” legislative package, the existent system cannot be disregarded. The legislator should not confine itself to apply/adapt the provisions. This article contains some hints for the analysis of the main issues of the present system, hoping to contribute for the discussion and perfecting the legal framework of Energy Efficiency in Portugal.
