Abstract

In the context of constitutional policy studies, this article is intended to discuss the research and statements of Eugenio Bulygin and Pedro Moniz Lopes regarding the recurring debate about law-making through judicial activism. It proposes a discussion about judicial activism and its effects on the fundamental rights.
