Administrative arbitration: role of the Public Prosecutor in the arbitral proceedings

The recent revision on the Administrative Proceeding Code has expanded the subjects possible to be judged by an arbitration Court, in particular the article 180. º, n. º1, paragraph c. Notwithstanding, as the legislator did not create an arbitration institution to judge these matters, a proceeding model is missing on the legal system. The present study aims to explore some issues that may arise on the application of the voluntary Arbitration Law, in particular the intervention of the Public Prosecutor in the arbitratral proceedings.
