In the 40th Anniversary of the Constitution: a revisit of the 1976 Constituent Assembly in a new look of the President of the Republic constitutional statute

This paper, published in the 40th Anniversary of the 1976 Constitution of the Portuguese Republic, begins by giving a fair thank-you to the constituents and recovering, even briefly, their discussion concerning the President of the Republic. The constituents’ contribution to a reconstruction of the statute of the President of the Republic in a republican view is also appointed. Consequently, it is defended the mismatch of the concept of head of State in this (republican) view. Moreover, in this light, some ideas about a re-reading of the constitutional status of the President in the 1976 Constitution are presented
