The duty to dispense medicines by community pharmacies: by way of a commentary of a decision stated by the Judicial District of Azores

Abstract

The Local Instance of Santa Cruz da Graciosa – Judicial District of Azores, trough a decision of 1st of March 2016, held an interpretation and applied the duty to dispense medicines imposed to the community pharmacies that, in our opinion, could jeopardize the fundamental right of protection of health, stated at article 64.th, n.º 1 of the Portuguese Constitution. We considered appropriate to carry out an analytical study of the duty to dispense medicines by the community pharmacies, commenting the above mentioned judicial decision.
