Abstract

This text aims at commenting Miodrag Jovanović’s work on conceptualizing and defining the role of the Rule of International Law when applied to new governance realities such as the Global Administrative Law phenomena. For that matter, it builds on the same schematics as provided by the author, exposing a critical overview of his opinion, as well as acknowledging his contribute to the study of these matters. Through this comment, it is proposed a new view on the concept of Global Administrative Law, seeing it as more of a didactic concept that contemplates several different complexes Rules of Law, rather than a unitary reality, providing therefore a new segmented theoretical line of thought. It is argued that such new approach can only be made through an independent non-state-based conceptualization of International Law.
