The putative effects in the nullity of urban acts: between public interest and protection of legitimate expectations

Abstract

Unlike what happens in the General Administrative Law, in Planning Law general rule concerning worthlessness of administrative acts is void. Once this is characterized by the total lack of productivity of the legal effect of the act, but there may be effects of fact, it is even more necessary to safeguard the confidence generated by these acts. Perceive situations in which it must safeguard the particular factual situation and assign putative effects, thus disregarding the principle of legality, is the purpose of this Article.
