This paper compares a set of legal rules for the construction activity included in the first Civil Codes of Portugal (1867) and Brazil (1916). The main goal is to assess how the Old Portuguese legal tradition, established by the almotaçaria rules included in the Kingdom Ordinances since 1521, was preserved or innovated by the new legislation. The aim of this article is, therefore, to contribute to the knowledge of the legal constraints which affected the private construction activity.
