Abstract
The reflection we are invited to engage in falls under the umbrella of the Charter of Fundamental Rights of the European Union³ and takes place fifteen years after the proclamation of its original version⁴. However, as we know, the text underwent some amendments on the eve of the signing of the Treaty of Lisbon,5 and whilst this revision did not formally incorporate the Charter into the Union’s primary law, it did confer upon it “the same legal value as the Treaties” (Article 6(1) TEU), specifying in particular that its provisions “shall in no way (…) extend the competences of the Union as defined in the Treaties” (Article 6(1)).
