Public contracts, performance bond and Administrative Courts – brief note on the competent jurisdiction

Abstract

This article focus on the several decisions issued by the Courts in regard to the question of knowing which jurisdiction is entitled to decide on the judicial procedures through which the contractor tries to avoid the performance bond to be enforced by the public contracting party or reacts against the enforcement of such bond.
