From the Principle of Equality to the Principle of Diversity: a reinterpretation of constitutional guidance in the Portuguese case

The present article aims to re-read the principle of equality in Portuguese constitutionalism, considering the emergence of sociopolitical guidance that produces a de facto perspective upon the juridical interpretation. In that sense, despite the norm holding a more rigid frame, the idea of "treating as equal what is equal, and as different what is different," as a communis opinio interpretation, allows de facto policies of social justice, allowing one to ask if ex iusta causa the principle of equality is now a principle of diversity in the Portuguese constitutionalism.
