The European Union Court of Justice in defense of Human Rights

This research will address the performance of the Court of Justice of the European Union in defense of Fundamental Rights. The main objective is to investigate, through jurisprudence, how the Court of Justice, the CJEU, behaves when faced with a case of violation of the fundamental rights of European Union citizens, and as a secondary objective it will cover from the historical context of human rights to the positivization of fundamental rights in the European Union. The methodology will be qualitative, through bibliographical studies of books, dissertations, articles, and legislation that support the objectives of the work. The result of the research is that the Court of Justice of the European Union has, in its decisions, been working to protect the fundamental rights and freedoms of the citizens of the European Union against discriminatory acts, and therefore the application of equitable justice.
