A jurisgénese dos Direitos Humanos - Um significante perseguido pelo seu significado, entre 1945 e 1993

Em jeito de pequeno ensaio, de índole especialmente pedagógica, propomo-nos a recontextualizar a genealogia do significante «Direitos Humanos», privilegiando uma óptica anticolonialista e antirracista, enquadrada no Movimento académico dos Estudos Críticos do Direito. O ponto onfálico é naturalmente a Carta oriunda da Conferência de São Francisco, em 1945, onde surgiu pela primeira vez o significante – mas o momento de plenitude encontramo-lo na Conferência Mundial sobre Direitos Humanos de 1993, em Viena, onde o significante ficou enfim legitimamente alinhado com o seu próprio significado. Entre os dois marcos temporais, houve uma actividade seminal dentro e fora dos palcos da ONU, por parte de agentes outrora subalternizados, que só mais recentemente veio a ficar devidamente exposta – e para a qual se procura aqui também dar projecção. Ficará evidente que rever a jurisgénese dos «Direitos Humanos» não remonta a um simples exercício de memória. Ao invés, é um passo firme e indispensável na construção do Direito Internacional a devir, o qual terá de responder aos novos desafios da Humanidade. Uma Humanidade perspectivada na sua totalidade, sem o orientalismo jurídico que hegemonicamente maculou este campo.
