Resumen

Este estudo tem como propósito central analisar de forma abrangente como a Convenção das Nações Unidas sobre o Direito do Mar (CNUDM) estabelece normas e regulamenta a proteção e prevenção do meio marinho. De maneira sistemática, o artigo busca não apenas compreender a relevância da CNUDM para o direito internacional, mas também destacar sua influência no cenário jurídico global e para a proteção e preservação do meio marinho. A análise se estende para explorar os principais atributos da Convenção e suas implicações no direito internacional, proporcionando uma visão mais completa de seu papel no contexto ambiental. Ao examinar as características distintivas do texto da CNUDM, o estudo investiga suas inovações em comparação com outros tratados, avaliando sua aplicabilidade prática. Além disso, é dedicada atenção à complexa questão da soberania do Estado sobre os recursos naturais no contexto marítimo, com foco na responsabilidade de evitar danos ambientais a Estados terceiros e áreas além de sua jurisdição. Este artigo visa assim contribuir para uma compreensão mais aprofundada do impacto e da eficácia da CNUDM na preservação do meio marinho e no desenvolvimento do direito internacional.
