A ação jurídico-penalmente relevante corresponde ao primeiro elemento de valoração na imputação de um crime ao agente. No âmbito do Direito Penal, nem todos os comportamentos humanos são relevantes para esta imputação, mesmo em situações de violação de normas protegidas pela ordem jurídica, sendo necessária, para além da violação de um dever jurídico objetivo, o estabelecimento da ligação subjetiva entre o agente e o ato realizado, de ações conscientes e controláveis pela vontade. Pelo exposto, esta investigação procura, aportando as principais contribuições das áreas da neurociência, clarificar os mecanismos automáticos e inatos do comportamento humano executados nos atos reflexos e a sua consequente exclusão da imputação penal.
