A dissonância entre os objetivos de participação e o quadro regulatório da governação climática na UE

A emergência climática é uma realidade presente que solicita uma governação com uma abordagem “WoS” (“Whole of Society”), sendo consensual que a participação das partes interessadas e da sociedade são fundamentais para a implementação das ações necessárias. A Convenção de Aarhus impõe às respetivas Partes, entre as quais se encontra a UE e os seus EM, a implementação de mecanismos que promovam a participação do público, seja na definição de políticas e planos ambientais, seja em relação a ações, privadas e públicas, com incidência ambiental. É igualmente prevista a obrigação de assegurar o acesso a um reexame, administrativo ou judicial. O Regulamento Aarhus e o Regulamento da Governação Climática adotados na UE apresentam insuficiências que suscitaram críticas, incluindo na avaliação efetuada pelo Compliance Committee da Convenção de Aarhus. Verifica-se, assim, uma dissonância entre o quadro regulatório instituído e os objetivos proclamados.
