Revisit the Consumer Conflict Arbitration Centres in Portugal: recent developments and digitalization trends
Keywords:
Consumer Conflicts; Arbitration Centres; Mandatory arbitration; Consumer ODR.Abstract
The reexamination of the topic of out-of-court resolution of consumer disputes in Portugal is justified, at the present time, due to the changes introduced in recent years in this field, specifically by Law No. 144/2015 of 8 September, which is claimed to be the ADR law in Portugal, but also by Law No. 63/2019 of 16 August, which has extended the scope of mandatory arbitration to consumer disputes that do not exceed the jurisdiction of the courts of first instance. We also analyse the progressive digitalisation that has been experienced in the operation of consumer dispute arbitration centres and the virtualities or disadvantages inherent to electronic tools when applied to the resolution of consumer claims.
