Notes about the objective liability for consumer accident and Luso-Brazilian consumer protection against damage arising from product defects
Abstract
The present study makes an analysis of the general aspects of objective civil liability, from overcoming guilt as application filter from institute and the modeling of it by the legal architecture of consumer protection, victims of consumer accidents due to product defects. Therefore, we proceeded to an analysis of the structure protection established by legal systems from Portugal and Brazil, starting from the constitutional treatment given to the theme, passing through infra-constitutional rules that regulate the incidence of objective liability, notably with regard to the elements: Liability (supplier), injured (consumer), damages and compensation.
