Notes about Legitimate Defense in Brazilian Criminal Law

Abstract

 

Self-defense is a human’s natural reaction, reflecting its self-preservation instinct. Crime is the typical behavior, illegal and culpable. In this concept, the illegality or unlawfulness of action is related to the setback of human’s action in face of legal system In Brazil the chance of unlawfulness or antijuridicidade exclusion are in criminal’s law. Self-defense represents an undisputed, inalienable and irreversible individual’s right which aims to personal and protection in face of another’s unjustified attack, repelling force by force, aggression by facing aggression. Among the exclusionary’s causes of unlawful, there is the self-defense.

Gustavo Henrique Holanda Dias, Faculdade de Direito da Universidade Federal de Pernambuco

É Procurador Autárquico do Estado do Pará e exerce, desde janeiro de 2013, o cargo de Corregedor-Geral Penitenciário do Estado. Bacharel em Direito pela Universidade Federal de Pernambuco (UFPE) e aluno da pós-graduação lato sensu em Direito Penal e Processual Penal e Direito do Estado. Participou da extensão universitária promovida pela Universidade de São Paulo (USP) em Atividade Judiciária com usuários e dependentes de drogas. Ministra cursos, como professor convidado, na Escola de Governo do Estado do Pará (EGPA). É Membro Titular do Comitê Integrado de Corregedores do Sistema Estadual de Segurança Pública, do Comitê Estadual de Prevenção e Combate à Tortura do Pará e do Grupo de Monitoramento e Controle de Letalidade do Pará. Associado ao IBCCRIM - Instituto Brasileiro de Ciências Criminais.
