Restricciones al derecho de los funcionarios públicos a la libertad de opinión y de religión en Ucrania: experiencia de la UE y práctica del TEDH.

L'article est dédié à l'étude des problèmes juridiques de limitation du droit des fonctions publiques à la liberté d'opinion et de religion en Ukraine, en lien avec l'expérience de l'UE et la pratique du Tribunal européen des droits humains. Durant la préparation de l'étude et de ses conclusions, des méthodes appliquées à la recherche scientifique comme le dialectique, le formel-juridique, le sistémique, l'herméneutique, le comparativo-juridique, l'empirique, etc. Ces méthodes permettent aux auteurs de déterminer l'importance et la complexité de la limite du droit des fonctions. les citoyens à la liberté d'opinion et de religion, ainsi que leur lieu de décision du Tribunal européen des droits humains. L'article analyse les normes et les principes juridiques internationaux, les approches théoriques et juridiques pour la compréhension de la neutralité religieuse des fonctionnaires publics, l'analyse des types de leurs exigences et de leur réglementation législative et des modèles de relations entre l'État et l'Église dans l'État déterminé par l'UE. . Il est établi que la relation avec les personnes recherchées est nécessaire à partir des obligations internationales dans le domaine de la garantie du droit à la liberté de pensée, d'expression et de religion, en particulier la Convention pour la protection des droits humains et des libertés fondamentales de 1950, et une jurisprudence pertinente en la matière. Ces orientations pour améliorer la législation dans le contexte de l'intégration européenne de l'Ukraine sont définies comme étant liées à l'application des décisions du Tribunal européen des dirigeants humains dans la limite du droit des fonctions publiques à la liberté d'opinion et de religion.
