CARACTÉRISTIQUES DE L'APPLICATION DU DROIT À LA SUSPENSION OU AU REFUS TOTAL/PARTIEL DE REMPLIR UNE OBLIGATION EN CAS DE NON-RESPECT DE LA CONTRE-OBLIGATION PAR L'AUTRE PARTIE SELON LA LÉGISLATION CIVILE DE L'UKRAINE

Le but de la recherche est de déterminer la portée et le mécanisme d'application du droit du créancier à la suspension ou au refus partiel/total d'exécuter une obligation en cas de non-respect de la contre-obligation par le débiteur (obligations auxquelles le droit spécifié s'applique et le mécanisme de sa mise en œuvre). Contenu principal. La nature juridique du droit à la suspension ou au refus total/partiel de s'acquitter d'une obligation a été clarifiée : l'auteur est arrivé à la conclusion qu'il s'agit d'un moyen de protéger les droits et intérêts civils. L'attention est attirée sur le fait que le droit étudié peut s'appliquer en cas de non-respect d'une obligation négative par l'autre partie. Conclusions. Le droit de suspension ou de refus d'exécution d'une obligation s'applique aux obligations lorsque leur exécution n'est pas simultanée, mais une certaine procédure d'exécution des obligations des parties est prévue. Ce droit peut être appliqué en cas de non-respect par l'autre partie de son devoir principal dans le cadre de l'obligation, le non-respect d'un devoir auxiliaire n'autorise pas l'autre partie à suspendre ou à refuser son devoir.
