Issuing Authority in the European Investigation Order – Part II

The concepts of “judicial authority” and “issuing authority” have generated some discussions and interpretations by the Court of Justice of the European Union regarding the matter in relation to the European Arrest Warrant. Directive 2014/41/EU, of the European Parliament and of the Council, of April 3, 2014, was transposed through Law nº 88/2017, of August 21, that contains, in its article 3.º, in subparagraph c), the concept of "authority of issuance". Therefore, we intend to investigate whether the interpretation of that Court would extend in the same limiting terms to the mechanism of the European Investigation Order, for reasons relating to the independence of the Public Prosecutor's Office in relation to executive power. The judgment of the Court of Justice of the European Union, of December 8, 2020, in case C 584/19, clarified the issue.
