Overbidding and payment of lathes: the innovations brought by Law n.º 117/2019, of 13 september and its reflexes for the improvement of the Portuguese Civil Procedure in matters of inventory

The ideal is that the proportions of the interested parties are constituted by assets belonging to the heritage to be shared, whether it be an inheritance or a conjugal heritage. However, in practice, there are, due to several factors, serious difficulties in carrying out the sharing without being awarded to one or more interested parties whose value, taken as a whole, exceeds the value of the respective share. Generally, in shares carried out through inventory, this excess results from bidding and constitutes a source of the obligation to pay to pecuniary compensation.
Considering the recent reform of the inventory process, operated by Lei n.º 117/2019, de 13/09, and the practical interest in matters of excessive bidding and payment of pecuniary compensation, this text aims to identify the innovations brought by the new inventory regime regarding these matters. It also seeks to analyze the reflexes of such innovations for the desired improvement of the inventory process regime.
