The concept of jurisdiction for purposes of formal notice of preliminary rulings: the matter of arbitral courts
Abstract
A national judge, when interpreting a community provision or the validity of an act of the Union, has the right, when not obliged, to draw up an issue and send it to the Court of justice of the European Union through preliminary rulings.Turns out, that judges of arbitration courts, attending to the nature and characteristics of the court, are often denied that action, because their competency is not recognized for that effect.
