A noção de jurisdição para efeitos de interpelação de recurso prejudicial: a questão dos tribunais arbitrais
Résumé
Um juiz nacional, ao interpretar uma disposição comunitária ou a validade de um ato da União, tem a faculdade, quando não seja mesmo obrigado, de elaborar uma questão prejudicial e remetê-la ao Tribunal de Justiça da União Europeia através do recurso prejudicial.
Acontece que, os juízes dos tribunais arbitrais, atendendo à natureza e características do tribunal, muitas vezes é-lhes negado o referido recurso, por não ser reconhecida competência para o efeito.
