Tribunal Unificado de Patentes: Novos caminhos para a proteção de patentes na Europa

La reciente entrada en funcionamiento del Tribunal Unificado de Patentes responde finalmente a la necesidad de un control judicial efectivo de la patente europea y de la patente europea con efecto unitario. En este artículo se presenta el camino que ha conducido a la creación del Tribunal Unificado de Patentes, así como su estructura y competencias. También se analizan los casos recientes resueltos por el Tribunal Unificado de Patentes, en particular en materia de validación y revocación de patentes, forum shopping, interpretación de la reivindicación de la patente y consiguiente valoración de la patentabilidad. Dada la existencia de algunos aspectos comunes entre el “United States Court of Appeals for the Federal Circuit” y el Tribunal Unificado de Patentes, se analizarán también algunas cuestiones jurídicas comunes a estos dos tribunales de patentes.
