Tribunal Unificado de Patentes: Novos caminhos para a proteção de patentes na Europa

L’entrée en vigueur récente de la Cour unifiée des brevets répond enfin à la nécessité d’un contrôle juridictionnel efficace du brevet européen et du brevet européen à effet unitaire. Cet article présente le cheminement qui a conduit à la création de la Cour unifiée des brevets, ainsi que sa structure et ses compétences. Les affaires récentes jugées par la Cour unifiée des brevets sont également analysées, notamment en ce qui concerne la validation et la révocation des brevets, le forum shopping, l’interprétation de la revendication de brevet et l’évaluation conséquente de la brevetabilité. Compte tenu de l’existence de certains aspects communs entre la « Cour d’appel des États-Unis pour le circuit fédéral » et la Cour unifiée des brevets, certaines questions juridiques communes à ces deux cours des brevets seront également analysées.
