Resumo

A recente entrada em funcionamento do Tribunal Unificado de Patentes vem finalmente responder à necessidade de um controlo jurisdicional efetivo da patente europeia e da patente europeia de efeito unitário. Neste artigo é apresentado o trajeto ocorrido até à criação do Tribunal Unificado de Patentes, bem como a sua estrutura e competências. São também analisados recentes processos decididos pelo Tribunal Unificado de Patentes, nomeadamente em matéria de validação e extinção da patente, forum shopping, interpretação da reivindicação da patente e consequente avaliação da patenteabilidade. Dada a existência de alguns aspetos comuns entre o “United States Court of Appeals for the Federal Circuit” e o Tribunal Unificado de Patentes serão também analisadas algumas questões jurídicas comuns a estes dois tribunais de patentes.
