Caractéristiques de la réglementation réglementaire du financement par l'État du maintien du procès devant jury en Ukraine

L'article analyse les particularités de la réglementation juridique du financement par l'État de l'entretien des procès avec jury en Ukraine. Il a été établi que le financement public du système judiciaire en Ukraine est actuellement extrêmement limité, conséquence de la crise économique en Ukraine due à l'annexion temporaire de la République autonome de Crimée, aux affrontements militaires permanents dans l'est de l'Ukraine et à la coronavirus pandémique mondial. Il a été prouvé que dans les pays économiquement développés du monde, le niveau de financement public du système judiciaire dépend directement du potentiel économique de l'État et de sa position stable sur le marché économique mondial. Par conséquent, il est nécessaire que l'Ukraine, avant tout, s'efforce d'accroître sa position sur le marché économique mondial et de surmonter toutes les manifestations de la crise économique. Il a été établi que le procès devant jury est l'une des principales institutions du pouvoir judiciaire, le pouvoir judiciaire, et a été créé pour mettre en œuvre le principe de la participation directe du peuple à l'administration de la justice, qui est confirmé par les dispositions de la Constitution de l'Ukraine : "Procès devant jury" n° 3843 du 14.07.2020 et "À propos de l'introduction d'amendements à certains actes juridiques de l'Ukraine en raison de l'adoption de la loi ukrainienne" À propos du procès devant jury "n° 3845 du 14.07.2020, ont prouvé l'urgence d'améliorer davantage les mécanismes de procès devant jury, mais uniquement dans les procédures pénales, car en cas d'adoption par le Conseil suprême d'Ukraine, les procès devant jury n'auront aucune légitimité dans les procédures civiles. Sur la base des données statistiques citées, il a été établi que l'indemnisation monétaire pour un procès devant jury en Ukraine est minime par rapport aux États-Unis, au Canada ou en France. D'un autre côté, le Royaume-Uni, au contraire, ne prévoit pas dans sa législation d'indemnisation monétaire. ion de jurés ; seuls les voyages et les indemnités journalières existent. Le niveau élevé de la compensation monétaire des jurés dépend avant tout du développement social et économique du pays. La conclusion est tirée que les actions du législateur de ces dernières années sont dirigées vers le modèle classique du procès devant jury, qui existe dans de nombreux pays du monde, avec un niveau approprié d'aide financière et un niveau approprié de soutien logistique.
