Associação Criminosa - Uma Questão de Autoria
Résumé
O tipo legal de associação criminosa, sendo um tipo legal de crime complexo, leva a que os Tribunais Portugueses possam ter decisões ambiguas acerca do seu eventual preenchimento legal.
A confusão, nomeadamente no crime de tráfico de estupefacientes, entre o cometimento do crime de associação criminosa, o cometimento do crime em si mas com a agravação por os agentes do crime actuarem em bando ou mesmo como uma mera co-autoria é muito fácil pois as formas de co-autoria e o preenchimento do crime de associação criminosa são muitas vezes ténues.
Assim, perceber os limites, contornos e quais os requisitos necessários para que esteja preenchido o tipo de crime de associação criminosa e quem poderão ser os seus autores é fundamental e necessário, sendo aquilo a que nos propomos a explicar.
